Both Early Supports and Services and Preschool Special Education services are provided under the federal law Individuals with Disabilities Education Improvement Act of 2004 (IDEA 2004). Each state then uses IDEA 2004 as a baseline to create their state law and regulations. NH has a long standing history of providing additional protections for children with disabilities and their families. Infants and toddlers with disabilities ages birth through age 2 may receive services under Early Intervention, known as Family Centered Early Supports and Services (or ESS). Children with disabilities ages 3 to 21 may receive services under the NH Rules for the Education of Children with Disabilities. Below is information regarding the laws and regulations for both systems here in NH.
